HOW MUCH WILL IT COST OUR COMMUNITY SCHEME?

The monthly premium is R15,00 per unit in your community per month for legal services cover to the value of R300 000 per case / claim for your scheme. Our premiums are reviewed annually.

DO WE PAY ANYTHING APART FROM THE PREMIUM FOR THE BENEFITS?

No, there are no excess or hidden costs.

HOW TO APPLY FOR A POLICY?

You can complete a policy application with an accredited broker; or call us on 012 665 2500 for further information; or submit an enquiry for information or request a call back on our website.

WHAT IS OUR COMMUNITY SCHEME COVERED FOR?

We provide legal service cover to the value of R300 000 per case / claim in respect of the Insured Matters mentioned in the policy.

WHEN DOES THE POLICY START?

Your policy starts on the date of the first premium payment.

WHAT ARE YOUR EXCLUSIONS?

The CSL policy excludes:

  • Indemnification of the Insured in respect of payment of claims or damages awarded against the Insured in legal proceedings.
  • Any order in legal proceedings, made in respect of legal expenses, in favour of the Insured’s opponent and / or any other party in such proceedings.
  • The payment of any fine, penalty, tax, levy, surety, any witness fee, any costs pertaining to expert witnesses and expert witness reports, travelling or subsistence costs, any payment or reimbursement of money to the Insured, of whatever nature.
  • Insured Matters that occurred outside the borders of the Republic of South Africa.
  • Disputes with local authorities concerning services where dispute resolution processes apply.
  • Events or circumstances which had commenced or occurred or where the cause or grounds of action in respect of those events or circumstances arose prior to inception of the policy or within the 3-month waiting period.
  • Claims instituted after 90 days from the date of an insured event or from the date that the Insured became aware of an occurrence of an insured matter or a claim against it that falls within the ambit of an insured event.
  • Matters that are purely administrative in nature.
  • Matters relating to:
  • Business rescue proceedings
  • Liquidation proceedings
  • Investment and pension/provident fund disputes
  • Citizenship related legal problems of the Insured’s employees
  • Municipal services and water, electricity and rates account problems
  • Small Claims Court matters
  • SABC licenses
  • Land claims
  • Constitutional Court proceedings.
  • Any act or activity pertaining to political activity / riot, civil commotion, labour riot/strike/lockout or public disorder.
  • Ionising radiation or contamination by radioactivity from an irradiated nuclear fuel or any nuclear waste from the combustion of nuclear fuel.
  • The radioactive, toxic, explosive or other hazardous properties of any nuclear assembly or nuclear component thereof.
  • War, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, riot, rebellion; revolution, insurrection, military or usurped power, or confiscation or nationalisation or compulsory purchase, requisition, destruction of or restrictions or controls placed on or damage to property by or under the order of any government or public or local authority.
  • This Policy and all actions, whether actual or contemplated, brought against the Insurer and / or Insuresense by the Insured.
  • Matters that are, in the sole opinion of Insuresense, trivial.
  • Claims or disputes with a monetary value below R 5000 (five thousand Rand).
  • Any Legal Services required after the Insured’s maximum claim benefit has been reached.
  • All matters not specifically included in the definition of Insured Matters.

WHEN CAN OUR COMMUNITY SCHEME START USING THE BENEFITS?

  • From the start date of your policy you can start using the policy for advice. Only after you have the policy for more than three months, you will be entitled to the litigation and representation benefits.
  • Representation in any matter only becomes active after expiry of a 3-month waiting period from the policy start date and matters that arose prior to the policy start date, or within the 3-month waiting period, are excluded.

IS THERE A WAITING PERIOD?

Yes, a 3- month waiting period is applicable but only with regards to litigation and representation in court. You are entitled to advice from the start of your policy.

WHAT ABOUT PRE-EXISTING MATTERS?

Matters that existed or originated prior to the starting date of your policy are excluded. For those matters you are only entitled to advice.

HOW OFTEN CAN WE USE THE SERVICE?

As frequently as required

DOES CSL USE A CALL CENTRE?

We do not use call centres and all calls are attended to by lawyers.

WILL WE BE ASSISTED BY A LAWYER WHO IS AN EXPERT IN COMMUNITY SCHEMES LEGAL MATTERS?

Yes, always.

DO YOU HAVE BRANCH OFFICES?

No, we have a central head Office in Pretoria with a nationwide panel of over 2 500 attorneys and advocates.

WILL WE BE ASSISTED BY AN EXPERIENCED LAWYER?

Yes, each lawyer on our panel has a minimum of 5 years practicing experience.

WILL YOU HAVE A LAWYER IN MY TOWN?

Yes, we can assist you in any town/area in South Africa. Our legal panel reaches all 9 provinces.

HOW ARE PREMIUMS COLLECTED?

Premiums are collected via debit order.

WHEN CAN A POLICY BE CANCELLED?

Anytime

IS THERE A PRESCRIBED PERIOD WITHIN WHICH A CLAIM MUST BE LODGED?

Claims instituted after 90 days from the date of an insured event or on which the Insured became aware of an occurrence of an insured event or a claim against him that falls within the ambit of an insured event.
